The petitioner is languishing in custody for the offences punishable under Sections 272/273/411 of the Indian Penal Code and Sections 30(a)/32/41 of the Bihar Prohibition and Excise Act, 2016.

Liquor was allegedly recovered from a pickup van and it is alleged that the petitioner is owner of that van. Learned counsel for the petitioner submits that Annexure-2 would reveal that the petitioner has already sold the said vehicle to one Pandav Kumar in the year 2017 itself. Moreover, the petitioner has got no criminal antecedent. Investigation of the case is already complete.

No.34293 of 2020(2) dt.19-01-2021 2/2 Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sahebpur Kamal P.S. Case No.88 of 2019, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
