The petitioner is in custody since 03.06.2015 in connection with Minapur P.S. Case No. 185 of 2015 registered for offences punishable under Sections 304(B), 120(B) and 201 of the Indian Penal Code.
Learned counsel for the petitioners submits that though originally the case was registered under Section 304B but later on after enquiry the charge-sheet came to be submitted under Section 302 on account of the fact the marriage had taken place more than seven years back. Learned counsel for the petitioner further submits that during the course of investigation, it has also come on record that the victim lady was a woman of irritable temperament
Patna High Court Cr.Misc. No.174 of 2016 (3) dt.05-02-2016 2/2 and used to get angry on frivolous things.
Learned counsel appearing on behalf of the State submits that such a submission has been justified by certain statements made by co-villagers who have also stated that in fury, the lady consumed the poison.
Considering the nature of allegations and materials which have surfaced in the case diary, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction learned Chief Judicial Magistrate, Muzaffarpur in connection with Minapur P.S. Case No. 185 of 2015.
