The instant application has been filed for modification of the order dated 24.2.2021 passed in Cr. Misc. No. 30490 of 2020 wherein while granting bail to the sole petitioner in connection with Sonepur P.S. Case no. 52 of 2017, the petitioner was directed to surrender in the learned court below within a period of six weeks ie by 7.4.2021.

It is submitted by learned counsel for the petitioner that for reasons beyond the control of the petitioner as also because of the restrictions imposed due to the Covid-19 pandemic, the petitioner could not surrender within the time fixed by the aforesaid order dated 24.2.2021 and hence the instant application for modification.

It is prayed that the said order dated 24.2.2021 be

Patna High Court CR. MISC. No.53785 of 2021(2) dt.29-09-2021 2/2 modified to the suitable extent.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, the order dated 24.2.2021 (Annexure-1) passed in Cr. Misc. No. 30490 of 2020 is modified. The time granted therein for the petitioner to surrender in the learned court below is extended by a further period of four weeks from today. The remaining part of the order dated 24.2.2021 shall remain unchanged.

The modification application stands allowed to the above extent.

The application stands disposed of.
