JUSTICE SHIVAJI PANDEY ORAL ORDER 09-03-2021 In this case, the petitioners are apprehending their arrest in connection with Narpatganj P.S. Case No. 85 of 2017 registered for offences under sections 147, 148, 149, 341, 342, 323, 324, 325, 307, 332, 333, 353, 427, 452, 379, 224, 225, 337, 338, 504 and 506 of the Indian Penal Code.

As per allegation, about 200 persons including the

Patna High Court CR. MISC. No.34457 of 2020(2) dt.09-03-2021 2/2 present petitioners came near the policy party and tried to set free the apprehended accused Md. Ilyas from the custody of the police.

The petitioners have been shown to be the member of the mob and, except that, there is nothing against them. Looking to the entire facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 85 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. as also subject to condition that whenever the police will call the petitioners for investigation/interrogation, they will remain present and if they would not present themselves, the privilege of grant of anticipatory bail shall be deemed to have been canceled.
