The petitioner is in custody in connection with MMCH P.S. Case No.146 of 2020 for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016. In the instant case, total 180 litres of country made liquor was seized.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 04.08.2020.

Considering the fact that the petitioner is in custody since 04.08.2020, the Court below [Additional Sessions JudgeII-cum-Special Judge (Excise), Gaya] is directed to release the petitioner on bail after completion of nine months in custody on
