According to prosecution case itself, at the time of alleged occurrence, it was co-accused, Samta Yadav who was driving the vehicle and so far as petitioner is concerned; he was sitting in the said vehicle.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kasma P.S. Case No. 20 of 2015 corresponding to Sessions Trial No. 338A of 2015/07 of 2015 to the satisfaction of learned Special Judge, Aurangabad.
