2. The petitioner seeks regular bail in connection with Barun P.S. Case No.128 of 2024 lodged under Section 392 of the I.P.C. read with section 37 of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, the F.I.R. has been lodged against two named accused persons against whom there is allegation that the petitioner was in drunken state due to this reason, he was apprehended by the police and nothing was recovered in this case.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He submits that nothing incriminating has been recovered from his

Patna High Court CR. MISC. No.40006 of 2024(4) dt.10-07-2024 2/2 possession nor he was put on T.I.P. and his name has figured in this case by virtue of confessional statement of co-accused and the said co-accused has been granted bail in Cr. Misc. No.38683 of 2024.

5. Counsel further submits that the petitioner is in custody since 23.03.2024 having clean antecedent.

6. Learned counsel for the State opposes the prayer for bail.

7. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail, after framing of charge, if not framed, on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge-Excise-1st Aurangabad in connection with Barun P.S. Case No.128 of 2024, subject to the following conditions as laid down under Section 437(3) of Cr.P.C.
