====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL DUTTA MISHRA ORAL ORDER 06-08-2025 Heard learned counsel for the petitioners and learned APP for the State.

2. Petitioners seek regular bail in connection with Raghopur P.S. Case No.89 of 2025, registered for the offences punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 262, 263, 121(1), 121(2), 132, 109, 158, 351(2) of the B.N.S., 2023.

3. As per prosecution case, on secrete information the police team reached to the house of Niti Rai to arrest the accused persons of Raghopur P.S. Case No.142 of 2024 where they were hiding. After the arrest, a group of family members alongwith petitioners attacked the police team with sticks and iron rods attempting to free the arrested individuals. It is alleged that coaccused Vipul Kumar assaulted the informant with iron rod causing injury on his hand.

4. Learned counsel for the petitioners submits that the petitioners are innocent and have been falsely implicated in this case due to local village politics. He further submits that there is no specific allegation against the petitioners rather the allegation levelled against them is general and omnibus. Learned counsel submits that the injury to the injured is simple in nature. He further submits that petitioner no.1 has one criminal antecedent, whereas petitioner no.2 has no criminal antecedent. He also submits that petitioners are in custody since 31.03.2025 and they undertake to cooperate in the trial.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned District and Additional Sessions Judge-13, Vaishali at Hajipur/ concerned Court in connection with Raghopur P.S. Case No.89 of 2025.
