JUSTICE SATYAVRAT VERMA ORAL ORDER 14-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. Learned counsel for the petitioner very fairly submits that out of six prosecution witnesses, four prosecution witnesses have been examined and now only the official witnesses i.e. the Doctor and the I.O. remain to be examined.
Learned counsel in view of the submission made sought permission to withdraw the bail application. Permission is accorded with a direction to the learned court below to ensure that the trial be concluded within a period of four months from the date of receipt/production of a copy of this order and the Superintendent of Police, Kaimur at Bahbua will ensure that the official witnesses are made available when
Patna High Court CR. MISC. No.47605 of 2021(4) dt.14-02-2022 2/2 required by the court, failing which serious consequences against the Superintendent of Police, Kaimur at Bahbua will follow.
Accordingly, this application is dismissed as withdrawn in connection with Session Trial No. 49 of 2020 arising out of Adhoura P.S. Case No. 07 of 2020 pending in the Court of learned Additional Sessions Judge-IV, Kaimur at Bhabua.
In the event, if the trial is not concluded within a period of four months as recorded aforesaid the petitioner will be at liberty to renew his prayer for bail.
