2. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 392 of the Indian Penal Code pending in the learned court below.
3. As per the prosecution case, three unknown persons forcibly took the motorcycle of the informant and snatched the gold of his wife. It is also alleged the have also snatched purse of the informant's wife containing Rs. 30,000/-, mobile, ATM Card of HDFC Bank and fled away.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that petitioner is not named in the FIR. He submits that on the basis of the confessional statement of the
Patna High Court CR. MISC. No.39206 of 2023(3) dt.11-09-2023 2/2 co-accused Vikrant Kumar, the petitioner has been made accused in this case. He further submits that petitioner has got five criminal antecedents as stated in para-3 of the bail application.
5. Per contra, learned APP for the State vehemently opposing the bail application and submits that the allegation levelled as the petitioner is serious in nature. Hence, he does not deserve anticipatory bail.
6. Considering the facts and circumstances of the case and the fact that petitioner has five criminal antecedents, I am not inclined to enlarge the petitioner on bail in connection with Lalganj P.S. Case No. 367/2020. Accordingly, his prayer for anticipatory bail is hereby rejected.
