The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 504, 354 and 337 of the Indian Penal Code.
The prosecution case is that the informant being Assistant Teacher asked to the petitioner being Headmaster of the school for providing attendance register to mark attendance then register was not given, the informant was
Patna High Court Cr.Misc. No.10327 of 2016 (2) dt.03-03-2016 2/3 abused and assaulted and the petitioner tore the register and threw a piece of wood on the informant.
It is submitted by learned counsel for the petitioner that the petitioner being Headmaster of the school was made complain against non-performing of duty properly by the informant and hence, the accused has been levelled. For the occurrence of 08.01.2016 and 25.01.2016 the FIR was registered on 02.02.2016.
It is submitted by learned counsel for the informant that an enquiry was conducted by the Block Development Officer and who has found the accusation true. It is further submitted by learned counsel for the petitioner that the School Education Committee has not found the allegations levelled by the informant true. Considering the delayed lodging of the case coupled with the statement made in paragraph 3 of the petition that the petitioner has no criminal antecedent, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate,
