====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 10-08-2017 Heard the learned counsel for the petitioner. The petitioner seeks regular bail in connection with Mohania P.S. Case No. 236 of 2017,G.R. No. 1192 of 2017 registered for the offence punishable under Sections 379 and 411 of the Indian Penal Code.
The case of the prosecution is that the petitioner and one another accused persons were apprehended while the stolen motorcycle was recovered from them.
The learned counsel for the petitioner submits that the petitioner has a clean antecedent and as far as motorcycle is concerned, the same belongs to one Ram Nagina Singh who had given motorcycle to the petitioner in lieu of some money taken by him from the petitioner and the said Ram Nagina Singh had not
Patna High Court Cr.Misc. No.37971 of 2017 (2) dt.10-08-2017 2/2 filed any complaint with regard to theft of motorcycle, hence the allegation of theft of motorcycle by the petitioner is hypothetical. It is further submitted that the petitioner is languishing in jail since 26.5.2017.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Mohania P.S.
