JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 18-02-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report on the basis of suspicion but in course of investigation, it came to light that the stolen vehicle met an accident and at the time of above-said accident, stolen vehicle was being driven by the petitioner, who sustained injury in the said accident. Subsequently, the I.O. seized the vehicle, in question as well as driving licence of the petitioner.
Contention on behalf of the petitioner is that the petitioner was driver of the informant and as a matter of fact, there was some dispute between the informant and the petitioner on the point of wages and, that is the reason of false implication of the
Patna High Court Cr.Misc. No.3108 of 2016 (3) dt.18-02-2016 2/2 petitioner in the alleged crime. Moreover, there is nothing in the entire case diary to show that the petitioner had sustained injury in the so-called accident.
Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Jhajha P.S. Case No. 110 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Jamui. A.K.V./- (Hemant Kumar Srivastava, J) U T
