This is an application for bail in connection with Sasaram (Model) P.S. Case No. 473 of 2017, registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code. Petitioner is not named in the FIR and later on his name transpires during course of investigation.

Submission of learned counsel for the petitioner is that nothing has been recovered from his possession, rather recovery has been made from possession of co-accused, who has named this petitioner. Further submission is that he is accused in two other cases but he is on bail in those cases and he is in custody since 1.5.2017 and co-accused from whose possession recovery has been made has been granted bail by a co-ordinate Bench of this Court in Cr.Misc.No. 42539 of 2017, vide order dated 20.9.2017.

Having heard both sides and in view of facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Rohtas at Sasaram, in connection with Sasaram (Model) P.S.Case No. 473 of 2017, subject to the conditions as follows :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, his bail bond shall be cancelled.
