This application is for grant of regular bail in connection with Hajipur Sadar P.S.Case No.200 of 2017, registered for the offences punishable under Sections 147, 148, 149, 341, 323,337, 338, 307 and 302 of the Indian Penal Code. Allegation against the petitioners is of assault causing death of two persons and also injury to one person. Submission of the learned counsel for the petitioners is that except confession there is nothing against the petitioners and they are in custody since 15.5.2017.
Heard learned A.P.P. also, who has opposed the prayer for bail stating that three witnesses have named this
Patna High Court Cr.Misc. No.37785 of 2017 (3) dt.31-08-2017 2/2 petitoner as assailant in this case and there is allegation of brutally killing and causing seven injury on the person of the deceased and one injury to another injured also.
Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioners, at this stage, however, they may renew their prayer for bail after framing of charge in this case. With the aforesaid observation, this application is dismissed.
