The present application has been filed for restoration of LPA No. 1470 of 2017 which was dismissed for default for non-compliance of the order dated 17.5.2018.

The reason has been assigned in paragraph no.5 of the

Patna High Court MJC No.2429 of 2018(4) dt.17-10-2019 2/2 present application stating that under wrong impression, he failed to remove the defect and, in paragraph no.8, he has given an undertaking to remove the defect.

Accordingly, the counsel for the petitioner is directed to remove the defect within a period of two weeks after Diwali holidays.

In the result, this application for restoration is allowed and the LPA No. 1470 of 2017 is restored to its original file. (Shivaji Pandey, J) ( Partha Sarthy, J) rishi/- U
