Considering the fact that the petitioner herein, with the help of this application, made under Article 226 of the Constitution of India, has sought for upgradation of Middle School, at Sautadih,

Patna High Court CWJC No.5279 of 2016 dt.29-06-2016 2/2 District- Banka, and there is apparently a dispute with regard to the eligibility of the school, in question, we are of the view that the facts of the case are, in substance, same as in C.W.J.C. No.15789 of 2014 , which has been disposed of, on 24.08.2015, with the following directions:

"Without going into the merits of the claim, as raised by the petitioners in the present writ application, we direct that the Director, Secondary Education, Government of Bihar, to ensure that the dispute, as raised, is taken care of by the said three-man Committee and a decision is taken, in this regard, within a period of two months from the date of receipt/production of a copy of this order."
