JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 22-11-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 307 and some other ancillary Sections of the Indian Penal Code and u/s 27 of Arms Act.
As per the prosecution case, on 27.01.2020 while the informant along with his friends were going to Madhepura and reached near C.M. Science College, one Pradeep Kumar surrounded them with his Alto car and in the meantime petitioner shot from his pistol which hit Randhir Kumar below his eye causing him injury.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. In fact this petitioner was opposing eve teasing of a
Patna High Court CR. MISC. No.47404 of 2021(2) dt.22-11-2021 2/2 college girl by the informant and his friends for which some scuffle took place in which the victim received simple injury. Petitioner claims clean antecedent and is in custody since 18.02.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura in connection with Madhepura PS case No. 82/2020.
