The present transfer application has been filed on behalf of the petitioner seeking transfer of Matrimonial Case No.63 of 2018 from the Court of the learned Principal Judge, Family Court, Muzaffarpur to the Court of the learned Principal Judge, Family Court, Patna.

The learned counsel appearing for the opposite party appears and submits that the opposite party does not oppose the transfer rather he is willing to contest the case at Patna even. Since the learned counsel appearing for the opposite party based on instruction has consented for transferring the

Patna High Court MJC No.2440 of 2018(4) dt.12-05-2023 2/2 case from the Court of the learned Principal Judge, Family Court, Muzaffarpur to the Court of the learned Principal Judge, Family Court, Patna, as such, Matrimonial Case No.63 of 2018 pending in the Court of the learned Principal Judge, Family Court, Muzaffarpur is transferred to the Court of the learned Principal Judge, Family Court, Patna.

The learned Principal Judge, Family Court, Muzaffarpur shall ensure that the file along with entire records of the Matrimonial Case No.63 of 2018 is sent expeditiously to the Court of the learned Principal Judge, Family Court, Patna, preferably within a period of one week from the date of receipt/production of a copy of this order.

It is clarified that since the Matrimonial Case No.63 of 2018 stands transferred, as such, the order granting stay of the proceeding automatically get vacated.
