JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 14-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. There is specific allegation of rape against the petitioner but submission on behalf of the petitioner is that the medical report does not corroborate the allegation. The victim appears to be minor.
Taking into consideration the allegation, levelled against the petitioner as well as submission of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Chowk P.S. Case No. 180 of 2014 corresponding to Special Case No. 11 of 2015 (POSCO) pending in the court of learned Additional Sessions Judge-Ist, Patna stands rejected.
