JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-09-2017 Heard learned counsel for the petitioner.

This is an application for bail in connection with Special Case No. 9 of 2014, arising out of R.C.Case No. 24A of 2014 registered for the offences punishable under Sections 420, 467, 468, 471, 120B of the Indian Penal Code and 13(2), 13(i)(d) of Prevention of Corruption Act.

Petitioner is not named in the FIR and later on his name transpires during course of investigation and he has been arrested. Submission of learned counsel for the petitioner is that except confessional statement there is nothing against him and he has been falsely been implicated in this case. Further submission is that petitioner is Principal of Sanskrit Maha Vidyalaya and he is in custody since 8.6.2017 and charge sheet has been submitted in this case.

Heard learned for CBI, who has opposed the prayer for bail stating that some forged and fabricated documents, on the basis of which fake appointments have been made in Postal Department, have been recovered from his house and office also

No.38864 of 2017 (4) dt.14-09-2017 2/2 Having heard both sides and in view of facts and circumstances, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, CBI-II, Patna, in connection with Special Case No. 9 of 2014, arising out of R.C.Case no. 24A of 2014, subject to the following conditions :- (1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear in court on each and every date fixed in the case and also he will cooperate with CBI authorities as and when required and co-operate in disposal of trial, otherwise his bail bond shall be cancelled.
