JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-07-2023 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with S.Tr. No. 292 of 2023/55 of 2023, arising out of Shakurabad P.S. Case No. 107 of 2021, registered for offence punishable under Sections 304(B), 201/34 of the Indian Penal Code.

As per allegation, the marriage of the sister of the informant was solemnized with co-accused Jitendra Manjhi, six years prior to lodging of the FIR. The couple were blessed with two children. The accused persons tortured the informant's sister for non-fulfillment of demand of a motor-cycle as dowry. Ultimately, she was burnt alive by the accused persons.

No.37527 of 2023(2) dt.03-07-2023 2/3 The learned counsel for the petitioner has submitted that the petitioner is innocent and he is cousin Devar (brotherin-law) of the deceased, having no concern with day-to-day affairs of the couple. He has submitted further that on similar allegation, the father-in-law of the deceased has been granted bail, vide Cr. Misc. No. 70835 of 2022. He has also submitted that the specific allegation against the petitioner, as per FIR, is that he chased the informant when he went to the place of occurrence.

On the other hand, the learned APP has opposed the prayer for bail.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand rupees) with two sureties of the like amount each to the satisfaction of learned A.D.J.-I, Jehanabad in connection with S.Tr. No. 292 of 2023/55 of 2023, arising out of Shakurabad P.S. Case No. 107 of 2021, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in
