2. This application has been filed on behalf of the petitioner seeking a direction upon the respondent to release the seized amount of Rs. 7,53,140/- and Nokia Mobile Model-101 Brown Colour in favour of the petitioner which was seized in connection with Phesar P.S. Case No. 83 of 2013.

3. Learned counsel for the State has submitted that the State is ready to release the amount in question.

4. In view of the above, there is not dispute with regard to the prayer of the petitioner.

5. Accordingly, this application is disposed of with a direction to the SHO, Phesar Police Station, Aurangabad to release the amount of Rs. 7,53,140/- forthwith as the accused who was put on trial has already died.

6. Let a copy of this order be communicated to the Superintendent of Police, Aurangabad through FAX for its compliance.
