The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 149, 323, 325, 307, 379 of the Indian Penal Code and 3(1)(x) of SC/ST (Prevention of Atrocities) Act. The prosecution case is that the petitioners along with five others abused the informant by calling caste name and assaulted with lathi. Accused persons also snatched twenty thousand and mobile of the informant.
It is submitted by learned counsel for the petitioners that for the occurrence of 11.11.2015 at 7.00 P.M. the
Patna High Court Cr.Misc. No.10305 of 2016 (2) dt.03-03-2016 2/2 FIR was registered on 12.11.2015 at 1.00 P.M. and in the background of petty dispute the accusation has been levelled. A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent. Moreover, the informant has retracted from the initial version and filed a petition to that effect before the learned court below.
The aforesaid facts constitute ground for consideration of prayer for regular bail, if the petitioners surrender before the learned court below within a period of six weeks from today in connection with Ramgarh P.S. Case No. 294 of 2015 pending in the court of learned Chief Judicial Magistrate, Kaimur at Bhabua.
