JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 15-01-2015 Heard learned counsel for the petitioners and learned counsel representing the State.

Petitioners apprehend their arrest in connection with Parwalpur P.S. Case No. 36 of 2014 registered for the offences punishable under Sections 341, 323, 307, 379, 448, 504, 506/34 of the Indian Penal Code.

It is submitted that there was free fight between the parties but the petitioner did not lodge the case and the informant lodged the case. The injuries found on the person of the informant and his wife are simple in nature caused by hard blunt substance and the opinion regarding injury no. 2 of the informant's wife has

No.29853 of 2014 (2) dt.15-01-2015 been kept reserved which is bruise on left palm, and as such, no case under Section 307 Indian Penal Code is made and the petitioners deserve sympathetic consideration to which the learned APP after going through the injury report does not dispute. In the facts and circumstances stated above, the petitioners above named, in case of their surrender or arrest within two months from the date of receipt/production of a copy of this order, shall be released on bail on execution of bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Hilsa, Nalanda in connection with Parwalpur P.S. Case No. 36 of 2014, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
