JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 20.12.2016 passed in Cr.Misc.No. 54720 of 2016 with a direction to the trial court to expedite the trial and conclude the same within a period of nine months. Submission of learned counsel for the petitioner is that period of nine months has already expired and the case is pending for evidence of official witnesses.

From the report received from the court below it appears that the case is pending for evidence of I.O. and Judicial Magistrate, who has recorded statement under Section 164 Cr.P.C. Learned trial court seeks two months time to conclude the trial. In the facts and circumstances, I am not inclined to grant

Patna High Court Cr.Misc. No.47973 of 2017 (4) dt.03-01-2018 2/2 bail to the petitioner.

However, learned trial court is directed to conclude the trial within a period of two months as sought by him. At the same time, Superintendent of Police, Saran is directed to ensure the presence of the I.O. in court on the date fixed. With the above observation, this application is disposed of.
