The petitioner is languishing in custody for the offences punishable under Sections 3/4/5 of the Immoral Traffic Act and Sections 30(a)/37(b)(c) of the Bihar Prohibition and Excise Act.
Allegation is that the petitioner and others were found in an objectionable condition with named females in the flat of the petitioner. The petitioner is in custody since 24.07.2020. The petitioner has stated on oath that he has got no such type of criminal antecedent. Investigation of the case is already complete.
Considering completion of investigation and period
Patna High Court CR. MISC. No.34069 of 2020(3) dt.19-03-2021 2/2 already undergone by the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Special Case No.4529 of 2020, arising out of Rupaspur P.S. Case No.233 of 2020, with following conditions:
(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
(c) The petitioner shall not leave the country without permission of the trial Court.
