Petitioners apprehend their arrest in a case registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code.

It is a case of dowry death.

Petitioner. No.1 is brother-in-law and petitioner No.2 is mother-in-law of the deceased.

Learned counsel appearing for the petitioners submits that petitioners are separate from the deceased in mess and property. There is no specific allegation against these petitioners and thrust of accusation is against the husband of deceased who

Patna High Court CR. MISC. No.37743 of 2022(3) dt.24-11-2022 2/2 is in custody. Petitioners have got no criminal antecedent. Learned counsel appearing for the State opposes the prayer for anticipatory bail.

Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in connection with Bettiah Town (Kalibag OP) PS case No. 728/2021, subject to conditions laid down u/s 438(2) of the Cr. P. C.
