JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2019 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 7.12.2018 in Cr.Misc.No. 65231 of 2018 with direction to learned Special Judge to conclude the trial within a period of four months and petitioner was given liberty to renew his prayer for bail if trial is not concluded. Submission of learned counsel for the petitioner is that four months period has already expired and trial has not yet commenced and petitioner is in custody since 10.8.2018. Heard learned APP also.

Having heard both sides and in the facts and circumstances, as stated above, let petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-II-cum-Special

No.36081 of 2019(3) dt.24-07-2019 2/2 Judge, Araria, in connection with Special Case No. 653 of 2018, arising out of Narpatganj P.S.Case No. 326 of 2018, subject to the conditions that one of the bailors shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and petitioner has to co-operate in the disposal of trial and appear in court as and when required, otherwise his bail bonds shall be cancelled.
