Petitioner is not named in the first informant report but from perusal of impugned order, it would appear that the name of this petitioner surfaced in course of investigation, when some witnesses expressed their suspicion against petitioner and others and also claimed that they had seen the petitioner and others near the place of occurrence.
Learned counsel for the petitioner submits that having more or less similar allegation, one co-accused namely, Ratnesh Mahto has already been granted privilege of bail by this court by order dated 18-09-2015 passed in Cr. Misc. No. 42698 of 2015. Considering the aforesaid facts and circumstances of the case as well as submissions of the parties, let the petitioner named
Patna High Court Cr.Misc. No.45 of 2016 (2) dt.05-01-2016 2/2 above, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Patahi P.S. Case No. 49 of 2015 to the satisfaction of Sri Prrahalad Kumar, learned Judicial Magistrate, Motihari, East Champaran.
