JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 409, 420 of the Indian Penal Code.
Earlier the prayer for bail of the petitioner was rejected by this court taking note of allegation levelled against him but admittedly, petitioner is in jail custody since 23.06.2016 and the charge against him has already been framed and the case is pending for prosecution evidence but up till now, not a single prosecution witness could be examined which is evident from perusal of letter no.174/17 of Additional Chief Judicial Magistrate, 1st, Khagaria.
Considering the aforesaid facts and circumstances as
Patna High Court Cr.Misc. No.52164 of 2017 (3) dt.17-01-2018 2/2 well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Allauli P.S. Case No. 150 of 2015.
