The petitioner apprehends his arrest in Jokihat P.S. Case No.27 of 2020 registered under Sections 379, 411 and 34 of the Indian Penal Code.
The learned counsel for the petitioner submits that petitioner is not named in the F.I.R. One Jitendra Vishwas was apprehended and from his possession, stolen fans and wall clock were recovered. Jitendra Bishwas is said to have disclosed the name of the petitioner in his confession but save and except the confession, there is no material to show the involvement of the petitioner in the theft. Petitioner has got no criminal antecedent. Learned A.P.P. did not dispute this fact.
Taking into consideration the facts that the name of the petitioner surfaced in the case on the confession of co-

No.34971 of 2020(4) dt.19-05-2021 2/2 accused but thereafter no tangible material is collected to show the involvement of the petitioner and petitioner has got no criminal antecedent, let the petitioner, above named, in the event of his arrest or surrender within a period of four weeks be released on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Jokihat P.S. Case No.27 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
