JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 12-04-2019 A counter affidavit has been filed today on behalf of the respondents. It is apparent from the statements made in paragraph '9' of the counter affidavit that the State respondents were sitting over the matter despite receipt of the letter of the Chief Engineer and other authorities of the Department. The Engineer-in-Chief, Rural Works Department has come out with a reasoned order No. 90 dated 03.01.2019, whereby considering the recommendation of the Regional Office a decision was taken

Patna High Court CWJC No.13903 of 2018(4) dt.12-04-2019 2/2 to delete the name of the petitioner from the debar list. Further vide Memo No. 1994 dated 11.03.2019, the name of the petitioner has been removed from the debar list. All these action have been taken only after filing of the present writ application.

Although the inaction writs large on the face of the record but in view of the action now taken by the respondent authorities, this writ application seems to have become infructuous and is disposed of accordingly.
