2. Petitioner seeks regular bail in connection with Nanpur P.S. Case No.343 of 2024 registered under Sections 103 and 61(2) of B.N.S.
3. As per prosecution case, in the evening of the alleged date of occurrence, the father (deceased) of the informant was seen eating together with Bechan Sahni and petitioner but the deceased did not return home in the night. On the next day, the dead body of the deceased was found in a ditch. It is further alleged that informant's father had got illicit relation with the daughter of co-accused Chandrakishor Sah and for the same, Chandrakishor Sah in conspiracy with Bechan Sahani, Ram Kumar Rai (petitioner) and two others had

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case only on the basis of suspicion. Prior to institution of the case, U.D. Case No.05 of 2024 had been lodged by the wife of deceased and she had not named the petitioner. Only allegation against the petitioner is that on the date of occurrence, the father of the informant along with Bechan Sahni and petitioner took food in the evening. It is further submitted that other two coaccused persons, namely, Chandrakishor Sah and Bechan Sahani have been granted bail by a coordinate Bench of this Court vide order dated 22.03.2025 passed in Cr.Misc.No.89006 of 2024 and Cr.Misc.No.88352 of 2024. The case of the petitioner is on better footing than the case of other co-accused persons. The charge sheet has already been submitted against the petitioner and there is no chance of tampering with the evidence or absconding of petitioner. Petitioner has no criminal antecedent. Petitioner is in jail since 28.03.2025. Petitioner undertakes to cooperate in the trial.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case as well as the submissions of the parties, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Pupari, Sitamarhi in connection with Nanpur P.S.
