The petitioner has filed the instant application for grant of anticipatory bail, apprehending his arrest in connection with Complaint Case No. 3469 (c) of 2017 registered for the offence under Section 498 A of the I.P.C. and under Section 4 of the Dowry Prohibition Act.

As per the complaint, the marriage between the complainant and the petitioner took place on 11.06.2014 and after living in her sasural for just seven days, the complainant was allegedly forced out of her in-laws' house. There is general allegation of torture, demand of dowry and assault. It is submitted by the learned counsel for the petitioner that cognizance has been taken under Section 498A of the I.P.C. and Section 4 of Dowry Prohibition Act. The allegations in the complaint petition are absolutely false and

Learned A.P.P. for the State opposes the prayer for bail.

Having heard the parties and taking into consideration the entire facts, the general and omnibus nature of allegations against the petitioner, delay in filing of the complaint and that the petitioner has no criminal antecedent,the petitioner, Manish Kumar @ Manish Sharma, in the event of his arrest or surrender before the Court below within a period of six weeks from today in connection with Complaint Case No. 3469 (c) of 2017, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Patna, subject to the conditions as laid down under Section 438 (2) of Cr.P.C.
