The petitioner has challenged the order dated 17.02.2024 passed by the court of learned Sub Judge - II, Patna in Title Suit No. 303 of 2021, whereby and whereunder the learned trial court has dismissed the petition filed by the petitioner/defendant no. 1 under Order VII Rule 11 of the Code of Civil Procedure.
3. If the petition of the petitioner would have been allowed, that would have been the end of the matter before the learned trial court and against such order a Civil Revision under Section 115 of the Code of Civil Procedure would lie.
4. At this stage, learned counsel for the petitioner seeks permission to convert the present petition into Civil Revision petition.
5. Permission is accorded.
