The petitioner seeks bail in Sonpur-Hajipur Rail P.S. Case No. 30/2018, G.R. No. 1611/2018, instituted for offences under Section 414 of the Indian Penal Code read with Sections 20, 22 and 08 of NDPS Act.

Earlier prayer for bail of petitioner was rejected by this Court vide order dated 26.10.2018 passed in Cr. Misc. No. 51202/2018 with liberty to renew prayer for bail after six months if no substantial progress is made in trial. It is alleged in the written report that total 17 Kg. Ganja has been recovered from possession of petitioner while he was travelling in train. Seizure list is part of First Information Report from which it appears that Ganja has been recovered

Patna High Court CR. MISC. No.36657 of 2019(4) dt.31-07-2019 2/2 from various bags as mentioned, in detail, in seizure list. Report from the court below regarding stage of trial has been received from which it appears that seven witnesses have already been examined. It is mentioned in the report that trial is likely to be concluded within three months. From the report of the court below it appears that trial has sufficiently progressed.

Therefore, this Court is not inclined to grant bail to petitioner. Prayer for bail of petitioner is again rejected. The trial court is directed to expedite the trial and conclude the same within a period of three months, as mentioned in the report of court below, from the date of receipt/production of copy of this order and send compliance report.
