The petitioners apprehend their arrest in Bikramganj P.S. case No. 213/2020 registered under Section 341, 323, 504, 307, 34 of the IPC.

The informant alleged that while he was repairing electric wire on pole his neighbours, Dhanjee Ram, petitioner No.4, Bhutali Ram, petitioner No.1, Sambhu Ram, petitioner No.2, Vijayi Ram, petitioner No.3 and Dudhnath Ram came there and began to abuse the informant on the allegation that the informant cut the wire of the house of the accused. When the informant asked them not to abuse all the accused persons assaulted the informant. Dhanjee Ram assaulted the father of informant with Lathi on his head. Dudhnath Ram assaulted Sushil Paswan with iron rod.

Patna High Court CR. MISC. No.35078 of 2020(2) dt.18-03-2021 2/2 The learned counsel for the petitioners submits that there is counter version being Bikramganj P.S. case No. 214/2020. Dhanjee Ram, petitioner No.4, is alleged to have assaulted father of the informant but father of the informant got lacerated wound and both the injuries are simple in nature. The informant also got simple injuries.

Taking into consideration the facts aforesaid and the fact that the scuffle took place between two sides for repairing of electric wire and both sides entered into mutual assault on each other and injured got simple injuries, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Bikramganj, Rohtas in connection with Bikramganj P.S. case No. 213/2020, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
