Heard learned counsel for the petitioners as well as the learned APP for the State.
At the outset, learned counsel for the petitioner has submitted that the petitioner No. 2 Nandan Kumar Jha has been arrested during the pendency of this petition. He therefore seeks permission to withdraw the anticipatory bail petition in respect of petitioner No. 2.
Patna High Court CR. MISC. No.39332 of 2022(2) dt.24-08-2022 2/3 In view of the aforesaid submission, the anticipatory bail petition of petitioner No. 2 is dismissed as withdrawn as having become infructuous.
The petitioner No. 1 apprehends his arrest in connection with Ghanshyampur P.S. Case No. 63 of 2022, registered for the offences punishable under Sections 341, 323, 324, 307, 504, 34 of the Indian Penal Code.
Learned counsel for the petitioner has submitted that there is land dispute between the parties. Both the parties are agnates. There is case and counter case and the members of prosecution side has also badly assaulted the members of defense side and made them injured. He has also submitted that injuries sustained by the injured persons are simple in nature. Considering the above-mentioned facts and circumstances, let the petitioners, in the event of their arrest or surrender within four weeks before the learned court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Biraul, District- Darbhanga in connection with Ghanshyampur P.S. Case No. 63 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.
Patna High Court CR. MISC. No.39332 of 2022(2) dt.24-08-2022 3/3 Office shall ensure that all defects are removed by the petitioners within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
