JUSTICE MADHURESH PRASAD ORAL ORDER 02-02-2018 Heard counsel for the petitioner and the State. Petitioner is an accused in a case registered for offence under sections 307, 353 and 34 IPC.

Counsel for the petitioner submits that the petitioner has falsely been implicated in this case by lodging three FIRs arising out of same occurrence. Two of them have been detailed in paragraph 3 of the bail petition in which he is already on bail and in the instant case other similarly situated co-accused have already been granted bail as mentioned in paragraph 10 of the bail petition. Petitioner has been remanded in this case on 2.5.2017.

Considering the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Sessions Judge, Samastipur in Sessions Trial No. 682 of 2017 on he following conditions:- (i) One of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner.
