JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 13-01-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is named in the first information report on the accusation that he demanded extortion money from the informant and his relatives and when demand was not fulfilled, he assaulted the informant as well as damaged his vehicle. The contention on behalf of the petitioner is that the present case has been lodged due to village politics and as a matter of fact, no such occurrence, as alleged in the first information report, did ever take place and so far as criminal antecedent of the petitioner is concerned, earlier only one case had been lodged against the petitioner and in the aforesaid case, petitioner has already been acquitted.
Patna High Court Cr.Misc. No.1277 of 2016 (2) dt.13-01-2016 2/2 Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Sonbarsa Raj P.S.Case No. 191 of 2015.
