JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 19-01-2017 Heard learned counsel for the parties.

In this case the petitioner is challenging an order passed by the Recovery Officer in Certificate Case No. 570/14-15. Learned counsel for the petitioner submits that the petitioner has already challenged the order of Recovery Officer before the Civil Court in suit which has been withdrawn. In that view of the matter, this Court is not required to look into the matter.

Patna High Court CWJC No.17827 of 2016 dt.19-01-2017 This order has been passed on account of objection raised by the learned counsel for the Bihar State Food and Civil Supplies Corporation Ltd. that the present writ application is not maintainable on account of availability of appropriate forum of appeal under the Bihar and Orissa Public Demand Recovery Act. It is for the petitioner to take corrective measures.

With the aforementioned observation, this application is disposed of.
