The petitioners seek bail in a case instituted for the offences under Section 379 of the Indian Penal Code. The prosecution case in short is that unknown accused persons looted the vehicle of the informant.

It has been submitted on behalf of the petitioner that the petitioners are in custody since 24.1.2019. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. The petitioners are not named in the F.I.R. The name of the petitioners have come on the basis of confession of

Patna High Court CR. MISC. No.34743 of 2019(3) dt.21-06-2019 2/2 co-accused. There is no recovery of any incriminating articles from the possession of the petitioners. The petitioners have not been put on T.I.P.

On behalf of the State, it is submitted that the petitioners are not named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Ishakchak P.S. Case No. 175 of 2018.
