Petitioner apprehends arrest in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 342, 353, 307, 224, 225, 505, 506, of the IPC. As per the prosecution case, it is alleged that this petitioner along with other named 5-6 unknown persons attacked the police party and got Ranjay Rai freed from the police custody and during the course Choukidar Ramesh Singh sustained injury.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The allegation against the petitioner is general and
Patna High Court CR. MISC. No.38390 of 2022(2) dt.22-11-2022 2/2 omnibus in nature. Identification of the petitioner in the flash of torch is doubtful. Petitioner has got no criminal antecedent. Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st class, Muzaffarpur in connection with Gaighat (Benibad O.P.)
