In para 1 of the petition, it has been incorporated that by the order impugned, prayer of the petitioner has been rejected. While after going through the order impugned, it is evident that learned lower court has simply directed that after hearing the objection over the report filed by Survey Knowing Pleader Commissioner, the matter will be heard. Therefore, by such order, the prayer of the petitioner has not been disposed of whereupon the instant petition happens to be pre-matured and is accordingly, rejected.
