2. The petitioner is in judicial custody in connection with Hathauri P.S. Case No. 13 of 2022, GR No. 201 of 2022 and Tr. No. 3110 of 2022 for the offence punishable under Sections 120B, 364/34 of the Indian Penal Code lodged on 16.01.2022 by the informant, Manju Devi.

3. As per the prosecution story, the allegation against the accused persons is/are of taking away the informant's son Golu Kumar which led to the FIR.

4. In the investigation, the role of the petitioner cropped up, the victim boy was recovered and in his 164 Cr.P.C. statement, he has given role of this petitioner as the person who amongst other thrashed him and played an important role in abduction.

5. Though, learned counsel for the petitioner submits that some of the co-accused have been granted bail.

6. Learned APP points out that beside the fact he has six criminal antecedents which include section 302 of the Indian Penal Code as also the fact that the FIR lodged on 16.01.2022 but he came into judicial custody only on 26.06.2023.

7. In that background, for the present, this Court is not inclined to extend him the privilege of bail which is accordingly rejected.
