ANJANA MISHRA ORAL ORDER 20-06-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 19.03.2019 in connection with Sonbarsa Raj P.S. Case No.37 of 2019, Special (Excise) Case No.145 of 2019, registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and Sections 272 and 273 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the alleged recoveries were not from the conscious possession of the petitioner and one similarly situated co-accused Pankaj Mukhiya with similar allegation has since been extended the privilege of bail in Cr.Misc. No.30920 of 2019, vide order dated 29.04.2019.

Case No.37 of 2019, Special (Excise) Case No.145 of 2019.
