JUSTICE PRABHAT KUMAR JHA ORAL ORDER 17-03-2021 Heard the learned counsel for the petitioners and Mr. Ram Bilash Rai Raman, the learned Additional P.P. The petitioners apprehend their arrest in Koilwar P.S. Case No.395 of 2019, registered under Sections 366(A) and 34 of the Indian Penal Code and under Section 8 of the POCSO Act.

The informant altogether named seven persons for kidnapping of his minor daughter. The informant alleged that his daughter had gone to coaching class on 20.11.2019 at about 6.00 in the morning and while she was returning, Raja Kumar, son of Manoj Thakur, the petitioner no.1, and two others, namely, Rupesh Pandey and Vikash Kumar @ Sipahi, another son of petitioner no.1, kidnapped his daughter. The informant further alleged that petitioner no.1, Manoj Thakur, Putal Devi, Aditya Kumar and Rambali Thakur are also involved.

Learned counsel for the petitioners submits that on the

Patna High Court CR. MISC. No.34929 of 2020(2) dt.17-03-2021 2/2 face of it, it appears that the informant is not an eye witness of the occurrence. The informant alleged that sons of petitioner no.1 and one another kidnapped his daughter while she was returning to her house, but later on, the informant implicated the entire family members of Raja Kumar in the kidnapping case of his daughter.

Taking into consideration the facts aforesaid, I find that the petitioners deserve anticipatory bail. Accordingly, petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Bhojpur, Ara in connection with Koilwar P.S. Case No.395 of 2019, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
