1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Bettiah Muffasil (Manuapul) P.S. Case no.442 of 2020 registered under sections 379, 413 and 414 of the Indian Penal Code.

3. As per the prosecution case, the informant states that he heard some sound at 2 a.m. in the night from where he had parked his motorcycle. On getting up, he saw three persons taking away his motorcycle. On hulla being raised while one Dhiraj Yadav was arrested on the spot two of them managed to escape. It is stated that the accused who was caught disclosed the name of the accused who had managed to escape and which included the petitioner herein.

4. Learned counsel for the petitioner submits that neither the petitioner was arrested at the spot nor any incriminating article recovered from his possession. The only material against him is the statement of a co-accused made before police. The reason of false implication of the petitioner is his antecedents. He is in custody since 5.8.2022 and investigation in the case has concluded.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the FIR, his not having been arrested on the spot, his having remained in custody for 1 year 11 months since 5.8.2022 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Bettiah Muffasil (Manuapul) P.S. Case no.442 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran.
