JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 376 of the Indian Penal Code and Section 4 of POCSO Act.
The report of trial court reveals that parties in Special (POCSO) Case No. 161 of 2015 arising out of Malsalami P.S. Case No. 306 of 2015 has already closed their evidence and the aforesaid case is pending for argument.
Therefore, in the aforesaid circumstance, I do not think it proper to release the petitioner on bail. Hence, his prayer for bail in connection with Special (POCSO) Case No. 161 of 2015 arising out of Malsalami P.S. Case No. 306 of 2015 pending
Patna High Court Cr.Misc. No.59524 of 2017 (3) dt.17-01-2018 2/2 in the court of Additional Sessions Judge-I-cum Special Judge (POCSO), Patna stands rejected.
However, learned trial court is directed to dispose of the aforesaid case as early as possible.
